A traffic stop or causing a car accident can sometimes lead to criminal charges. A drunk driving charge is serious and can lead to severe legal penalties and personal hardships. A stop that results in a DWI could also involve other charges, such as reckless driving and refusal to use a breath-testing device.

A resident in Sparta Township, New Jersey, called the authorities after witnessing a Volkswagen Jetta crash into a stone retaining wall before fleeing the scene. Police caught up to and pulled over the reported vehicle and allegedly found the driver almost completely nude. Police claim that she struggled for about 10 minutes to dress herself.

After taking note of the damage to the car, police questioned her about the accident. According to the police, the woman said that she did not remember being in an accident and could not recall where she was headed.

The woman was charged with a DWI, refusal to submit to a breath test, careless driving, failure to report an accident, leaving the scene of an accident and failure to wear a seatbelt. The combination of these charges could lead to serious legal consequences such as jail time, a large fine and revocation of her driver's license.

But it's hard to imagine that this woman was simply driving drunk, noting how she behaved and what she was wearing. It is premature for people to jump to conclusions about her behavior and arrest. Perhaps the woman has some sort of substance abuse problem. If that is the case, then it would be fair to argue that the woman could be served better by going to treatment than simply being arrested and thrown in jail.
